§ 4 Gewährleistung/Haftung; Untersuchungspflicht des Kunden
1. Der Anbieter handelt mit gebrauchten/antiquarischen Bücher, Tonträgern, Filmen etc., die auf Grund Ihres Alters Gebrauchsspuren aufweisen können, die im jeweiligen Verkaufspreis bereits angemessen mindernd berücksichtigt sind. Die Waren werden insofern ausschließlich in den in unserem jeweils aktuellen Online-Katalog angegebenen Ausführungen geliefert. Alle im Katalog angebotenen Werke sind - wenn nicht gesondert angegeben - vollständig und dem Alter entsprechend im allgemeinen gut erhalten. Auf kleinere Mängel des Erhaltungszustandes, wie Stempel oder Namen auf Titelblättern, geringe Beschädigungen des Einbandes sowie einzelne Anmerkungen oder einzelne Unterstreichungen, wird in der Regel nicht besonders hingewiesen.
Der Käufer hat die Ware auf Vollständigkeit, Transportschäden, offensichtliche Mängel, Beschaffenheit und deren Eigenschaften unverzüglich zu untersuchen. Offensichtliche Mängel sind von dem Käufer unverzüglich, spätestens innerhalb von zwei Wochen ab Ablieferung des Vertragsgegenstandes schriftlich gegenüber dem Verkäufer zu rügen.
2. Sollten Online-Angaben zum Sortiment falsch gewesen sein, werden wir dem Kunden ein Gegenangebot unterbreiten, über dessen Annahme er frei entscheiden kann. Stellt sich heraus, dass bestellte Waren nicht verfügbar sind, behalten wir uns den Rücktritt vom Vertrag vor.
Darüber hinaus sind wir in Fällen von höherer Gewalt berechtigt, Lieferfristen zu verlängern. Hierüber werden wir den Kunden unverzüglich informieren.
§ 5 besondere Inhalte/Klarstellung
Bücher/Zeitschriften aus der Zeit 1933 - 1945, mit darin enthaltenen zeitgeschichtlichen oder militär-historischen Darstellungen und Inhalten, werden nur zu Zwecken staatsbürgerlicher Aufklärung, der Abwehr verfassungswidriger und verfassungsfeindlicher Bestrebungen, der wissenschaftlichen und kulturhistorischen Forschung usw. (§ 86 StGB) verkauft.
§ 6 Eigentumsvorbehalt (gemäß § 455 BGB)
1. Bei Verträgen mit Verbrauchern behält sich der Anbieter das Eigentum an der Ware (Vorbehaltsware) bis zum vollständigen Eingang aller Zahlungen aus dem Kaufvertrag vor.
2. Der Besteller ist immer Zahlungspflichtiger, auch wenn die Bestellung Namens und Auftrags anderer Personen erfolgt.

Reliure en plein maroquin aubergine, dos à cinq nerfs orné de fleurons dorés, date dorée en queue, dos légèrement décoloré, plats abondamment ornés de roulettes et filets dorés en encadrement, quatre écoinçons ornés de petits fers dorés enrichis dune pièce de maroquin mosaïquée bleue en médaillon estampée dun fleuron doré en son centre, roulettes dorées sur les coiffes, gardes et contreplats de papier marbré, ex-libris dErnest Stroehlin encollé sur le contreplat supérieur, encadrement de filets et roulette dorés sur les contreplats, double filet doré sur les coupes, très légers frottements sans gravité sur les coins, toutes tranches dorées. Très petit manque restauré en partie supérieure de la page de titre, sans atteinte au texte. Très rare satire anti-protestante, sous la forme dun dialogue entre Mestrezat, célèbre pasteur protestant et le surveillant du temple de Charenton dans lequel Mestrezat officiait. Le temple de Charenton sera détruit en 1685 lors de la révocation de lÉdit de Nantes. * Il sagit sans doute dune des expressions les plus théâtrales de la controverse entre catholiques et protestants, qui avaient alors changé les armes dacier pour celles de papier (Pierre de Beloy)?: «?Le temps de lédit de Nantes a été celui de la controverse interconfessionnelle, orale et écrite, le but étant de vaincre ladversaire, le réduire au silence, ou mieux le convertir, lamener de lerreur à la vérité?» (Marianne Carbonnier-Burkard). Techener qualifiera cette uvre de «?critique spirituelle et facétieuse?», ajoutant quil sagit dune «?pièce très rare, qui na pas été connue par les auteurs de la France protestante?» (Librairie Techener, 1888). Le temple de Charenton, où officiait Mestrezat, fut le lieu de culte des protestants parisiens au XVIIe siècle, alors que la célébration du culte réformé était interdite dans les grandes villes selon les stipulations de lÉdit de Nantes. On a même identifié le «?surveillant du temple de Charenton?» traité également de vulgaire lanternier dans ce pamphlet, comme étant le célèbre Pierre du Moulin, tout premier pasteur du temple, qui avait obtenu une vocation en 1599 pour léglise réformée de Charenton (Louis Mercier, Tombeau de la mélancolie. Littérature et facétie sous Louis XIII). Lauteur anonyme tourne les deux protagonistes en ridicule. Il met en scène Jean Mestrezat se plaignant au surveillant davoir été attaqué par «?le méchant petit abbé de Clausone?». Lardent controversiste Gabriel Martin, abbé de Clausone avait en effet écrit de violents pamphlets contre lui. Cet ouvrage pourrait-il être de la main de Clausone lui-même, se félicitant de ses propres écrits?? Quoi quil en soit, les reproches abondent sur lhérésie de la religion réformée, un «?ordre ecclésiastique dans lequel lon y voit un lanternier [le surveillant], tenir lun des premiers rangs?». Ce même lanternier sexclame dans ces lignes?: «?Je suis plus savant que tout les Conciles puisque je puis les censurer??» Superbe exemplaire à la prestigieuse provenance, habillé dune reliure en plein maroquin. Un seul autre exemplaire est répertorié à la Bibliothèque nationale de France. Provenance?: Ernest Stroehlin (1844-1907) docteur en théologie et professeur dhistoire de la religion à lUniversité de Genève avec son ex-libris gravé par Champel dont la devise est Mente Libera, son monogramme «?GES?» (Gaspard-Ernest Stroehlin) encollé sur le contreplat. Packaging: I use clean, recycled materials whenever possible, to reduce expenses. I pack books very thoroughly, so that they survive the vagaries of the US and international postal systems in good order; arriving safely, and as described. For US domestic orders, I use USPS Delivery Confirmation forms on all books, shipped in US, others when possible; these provide a handy tracking mechanism which I share with the purchaser.
