§ 4 Gewährleistung/Haftung; Untersuchungspflicht des Kunden
1. Der Anbieter handelt mit gebrauchten/antiquarischen Bücher, Tonträgern, Filmen etc., die auf Grund Ihres Alters Gebrauchsspuren aufweisen können, die im jeweiligen Verkaufspreis bereits angemessen mindernd berücksichtigt sind. Die Waren werden insofern ausschließlich in den in unserem jeweils aktuellen Online-Katalog angegebenen Ausführungen geliefert. Alle im Katalog angebotenen Werke sind - wenn nicht gesondert angegeben - vollständig und dem Alter entsprechend im allgemeinen gut erhalten. Auf kleinere Mängel des Erhaltungszustandes, wie Stempel oder Namen auf Titelblättern, geringe Beschädigungen des Einbandes sowie einzelne Anmerkungen oder einzelne Unterstreichungen, wird in der Regel nicht besonders hingewiesen.
Der Käufer hat die Ware auf Vollständigkeit, Transportschäden, offensichtliche Mängel, Beschaffenheit und deren Eigenschaften unverzüglich zu untersuchen. Offensichtliche Mängel sind von dem Käufer unverzüglich, spätestens innerhalb von zwei Wochen ab Ablieferung des Vertragsgegenstandes schriftlich gegenüber dem Verkäufer zu rügen.
2. Sollten Online-Angaben zum Sortiment falsch gewesen sein, werden wir dem Kunden ein Gegenangebot unterbreiten, über dessen Annahme er frei entscheiden kann. Stellt sich heraus, dass bestellte Waren nicht verfügbar sind, behalten wir uns den Rücktritt vom Vertrag vor.
Darüber hinaus sind wir in Fällen von höherer Gewalt berechtigt, Lieferfristen zu verlängern. Hierüber werden wir den Kunden unverzüglich informieren.
§ 5 besondere Inhalte/Klarstellung
Bücher/Zeitschriften aus der Zeit 1933 - 1945, mit darin enthaltenen zeitgeschichtlichen oder militär-historischen Darstellungen und Inhalten, werden nur zu Zwecken staatsbürgerlicher Aufklärung, der Abwehr verfassungswidriger und verfassungsfeindlicher Bestrebungen, der wissenschaftlichen und kulturhistorischen Forschung usw. (§ 86 StGB) verkauft.
§ 6 Eigentumsvorbehalt (gemäß § 455 BGB)
1. Bei Verträgen mit Verbrauchern behält sich der Anbieter das Eigentum an der Ware (Vorbehaltsware) bis zum vollständigen Eingang aller Zahlungen aus dem Kaufvertrag vor.
2. Der Besteller ist immer Zahlungspflichtiger, auch wenn die Bestellung Namens und Auftrags anderer Personen erfolgt.

1.2 Deze Algemene Voorwaarden zijn met uitsluiting van enige andere voorwaarden van toepassing op alle rechtsbetrekkingen, waarbij Het Antiquariaat als leverancier van producten optreedt.
1.3 Het Antiquariaat aanvaardt geen enkel voorbehoud bij bestellingen door de wederpartij (hierna te noemen: de afnemer).
1.4 Het Antiquariaat behoudt zich het recht deze voorwaarden te allen tijde te wijzigen. De afnemer erkent dat Het Antiquariaat bevoegd is deze Algemene Voorwaarden te wijzigen en aanvaardt gebonden te zijn aan aldus gewijzigde Algemene Voorwaarden.
2. Conditie producten
2.1 Alle producten zijn in goede antiquarische staat, tenzij in de catalogus of correspondentie anders is vermeld.
3. Betaling
3.1 Betaling vindt contant bij afhalen plaats , door middel van vooruitbetaling via bank/giro, middels remboursement of door middel van een toegevoegde rekening. Dit tenzij schriftelijk anders wordt overeengekomen.
Het Antiquariaat is gerechtigd indien de betaling van het verschuldigde bedrag niet door haar is ontvangen, aan de afnemer een rente van 1% per maand te berekenen, gerekend vanaf de dag waarop de betaling uiterlijk had moeten plaatsvinden.
3.2 . Indien de bestelling op rekening wordt uitgeleverd, dient betaling binnen 14 dagen na dagtekening van de factuur te geschieden.
3.3 Levering op rekening is uitsluitend mogelijk indien geen voorgaande facturen open staan
3.4 Het Antiquariaat is voorts gerechtigd, buiten de hoofdsom en rente om van de afnemer alle kosten, zowel gerechtelijke als buitengerechtelijke, door de verzuimde betaling veroorzaakt te vorderen, waaronder de kosten van advocaat, procureur, zaakwaarnemer, gerechtsdeurwaarder en incassobureau. Voor het in verzuim stellen van de afnemer is Het Antiquariaat gerechtigd de werkelijke kosten in rekening te brengen, te verhogen met een redelijk bedrag aan kantoorkosten.

6.1 Het Antiquariaat is niet aansprakelijk voor schade toegebracht door aankoop en/of gebruik van geleverde producten.
6.2 Het Antiquariaat is niet aansprakelijk voor schade toegebracht tijdens verzending van de geleverde producten.
6.3 De termijn genoemd bij 5.3 geldt als een indicatie en niet als fatale termijn. Het Antiquariaat is nimmer aansprakelijk voor schade als gevolg van overschrijding van deze levertijd.
7. Retourzending
7.1 Retourzending is mogelijk na overleg met Het Antiquariaat en het geleverde product binnen 14 dagen na levering weer in bezit van Het Antiquariaat is.
7.2 Het product zal dan terugbetaald worden, exclusief de verzend- en verpakkingkosten.
7.3 Kosten die voortvloeien uit een retourzending (bijvoorbeeld verzendkosten) worden gedragen door de afnemer.
7.4 Ongefrankeerde retourzendingen worden niet aangenomen.
8. Verzendkosten
8.1 Het Antiquariaat berekent de verzend- en verpakkingskosten per bestelling. De kosten zijn afhankelijk van het formaat, gewicht en aantal producten.
9 . Schadevergoeding
9.1 Het Antiquariaat kan slechts aansprakelijk gehouden worden voor schade, die aan haar opzet of grove schuld is toe te rekenen, dan wel ontstaan is door omstandigheden die op grond van dwingendrechtelijke regels voor haar risico komen en daarbij zal haar aansprakelijk in waarde nooit die van de verkoopprijs te boven gaan.
9.2 Omstandigheden, die in ieder geval niet voor risico van Het Antiquariaat komen zijn: werkstaking, werkliedenuitsluiting, ziekte, in-, uit- en/of doorvoerverbod, transportproblemen, het niet nakomen van de verplichtingen door toeleveranciers, storingen in de productie, etc.
